This Privacy Policy explains how Gastronomika ("we," "our," or "us") collects, uses, shares, and protects the personal data of users ("you" or "your") who use our mobile application (the "App").

This Policy complies with:

  • The Swiss Federal Act on Data Protection (FADP)
  • The EU General Data Protection Regulation (GDPR)
  • Applicable U.S. laws, including the California Consumer Privacy Act (CCPA)

By using the Gastronomika App, you agree to the terms of this Privacy Policy. If you do not agree, please do not use the App.

We collect personal data directly from you, and where applicable, from third parties such as payment processors or public business databases.

User-Generated Content

Our App allows users to upload images of food products. These images may be published publicly and may be visible to other users within the App.

We kindly ask users not to upload any images that contain faces, identifiable individuals, or other personal data. The uploaded images are intended to depict food products only.

While such content is not meant to include personal data, we process and store it to provide the service (legal basis: Article 6(1)(b) GDPR – performance of a contract). If a user nevertheless uploads content that includes personal data, this data may be made public as part of the service. Users can request the removal of such data at any time by contacting us at info@gastronomika.app.

5. How We Use Your Information

We use personal data to:

  • Provide and manage your account
  • Process payments and subscriptions
  • Respond to inquiries and support requests
  • Enforce our terms and prevent fraud
  • Improve and personalize your experience
  • Comply with legal obligations

If you subscribe or make a payment, you may receive transactional emails directly from Stripe, our payment processor.

Gastronomika may also contact you by email regarding questions about content you have uploaded or to resolve technical or payment-related issues.

We do not engage in automated decision-making that produces legal or similarly significant effects on users.

6. Sharing of Personal Information

We share information with:

  • Hosting and infrastructure: Hostinger (EU-based data centers)
  • Payment processing: Stripe
  • Analytics and support services
  • Customer support platforms

Data may be transferred outside the EU or Switzerland. We use adequate safeguards such as Standard Contractual Clauses.

Hostinger operates EU-based servers and holds ISO/IEC 27001:2017 certification.

Stripe complies with GDPR and PCI DSS standards.

7. International Data Transfers

Your data may be stored and processed outside the EU/Switzerland.

We only use processors that implement appropriate safeguards, including Standard Contractual Clauses and recognized security certifications.

8. Your Privacy Rights

Under GDPR (EU/Swiss users): access, rectification, erasure, restriction, portability, objection.

Under CCPA (California residents): right to know, deletion, opt-out (we do not sell or share data), non-discrimination.

To protect your privacy, we may ask you to verify your identity before responding.

You may withdraw consent at any time by contacting us.

9. Data Retention

We retain user account data for as long as the account is active and up to 12 months after closure unless required by law.

When data is no longer needed, we securely delete or anonymize it.

10. Location Data

Users may share their location by:

  • Allowing mobile geolocation
  • Entering their address manually
  • Setting their location in the App

You may disable location sharing at any time. Some features may be limited if disabled.

11. Data Security

We implement encryption, access controls, and audits to protect data.

In case of a data breach, we will notify affected users and authorities as required by law.

12. Children's Privacy

We do not knowingly collect data from children under 13.

Where required by local law, parental consent is obtained for users between 13 and 16 years old.

13. Data and Account Management

Gastronomika does not currently provide an in-app option to delete or modify all of your account data directly.

If you wish to edit, delete, or receive a copy of your data, or withdraw consent, please contact info@gastronomika.app.

We will process verified requests promptly in compliance with applicable laws.

14. Cookies and Tracking Technologies

We do not use cookies or similar technologies.

15. Data Breach Notification

In case of a data breach, we will notify affected users and relevant authorities as required by law.

16. Updates to This Policy

We may update this Policy periodically.

Material changes will be communicated via the App or by email.

Continued use of the App indicates acceptance of the updated Policy.
